How to determine Child Support in Utah

One of the questions I get asked all the time is about child support.  Child support can be tricky depending on several factors; however, the essence of Utah child support can be calculated rather easily.  You go to the ORS website and click on the link for child support calculator.  You’ll be taken to the webpage that you see in this video.  Once you are there, you fill out each of the questions.  I explain all of this in the video.


You need to put in the mother and father’s name.  You need to put in how many children are subject to the support case.  You need to then put in the amount of gross income that both the father and mother make.  Remember, gross income is the amount of money you make in a month before taxes are taken out.  Then you put in the custody arrangement (how many overnights, etc.).  Finally, you put in other information about prior awards and other kids, etc.

 

Once you fill out the form, you click on the submit button and are taken to a PDF in your internet browser that has done the child support calculation for you.  That is the child support worksheet amount that should be followed.  Keep in mind that in order to change the child support obligation, you are going to have to show good cause or a really good reason as to why you are making the change.  The judge also has to approve it.

 

Also, you should know that courts don’t let you not have a child support award.  In other words – you have to put a child support calculation into your custody order or decree.  The judge won’t sign it unless there is child support being paid.  The court’s job is to protect the best interests of the child.  One of the ways courts do that in Utah is by making sure that there is money for the kids being paid each month.  Keep that in mind for your custody or divorce case.
